Main rights for cancelling a distance sale

• Cancellation period: a product purchased on the website may be cancelled from the transaction date until 14 days after receiving the product or the document containing the transaction details — whichever is later.
• Eligible consumers: a person with a disability, a senior citizen aged 65 or older, or a new immigrant may, subject to the conditions set by law and where the transaction included a conversation with the business (including electronic communication), cancel a distance sale within four months. Appropriate proof of eligibility may be requested.
• Refund: following a lawful cancellation, the amount paid will be refunded and the charge cancelled within 14 days after receiving the cancellation notice, in accordance with applicable law.
• Cancellation fee: where cancellation is not due to a defect, nonconformity, late delivery or another breach by the business, a fee of up to 5% of the transaction price or ₪100 may be charged — whichever is lower.
• No cancellation fee: no cancellation fee will be charged when cancellation results from a defect, nonconformity, late delivery or another breach of the transaction by the business.

Returning the product and exceptions

When cancellation does not result from a breach of the transaction, the customer must return the product to the business. When cancellation results from a defect, nonconformity, late delivery or another breach by the business, the product must be made available to the business at the place where it was delivered.

The cancellation right does not apply in cases excluded by law, including, among others, perishable goods, goods made especially for the consumer following the transaction, information as defined by law, and goods capable of recording, reproduction or duplication whose original packaging was opened. This does not limit the business’s right to claim damages where the product’s value was substantially reduced by a significant deterioration in its condition.
